Throughout this website, the terms “we”, “us” and “our” refer to Class Ready. Class Ready provides this website, including all information, products, stationery packs, features and services available through the website, subject to your acceptance of these Terms of Service.

The terms “you”, “your” and “customer” refer to any person who visits, browses or purchases from our website.

By visiting our website, creating an account, placing an order or purchasing any product from us, you agree to be bound by these Terms of Service, our Return and Refund Policy, Privacy Policy, Shipping Policy and any other policies displayed on our website.

Please read these Terms of Service carefully before using our website.

Nothing in these Terms of Service is intended to limit or exclude any rights that you may have under the:

  • Consumer Protection Act 68 of 2008;

  • Electronic Communications and Transactions Act 25 of 2002;

  • Protection of Personal Information Act 4 of 2013; or

  • Any other applicable South African law.

Where any provision of these Terms conflicts with a mandatory provision of South African law, the applicable law will take priority.

3. Eligibility to Use Our Website

By using this website or placing an order, you confirm that:

  • You are at least 18 years old;

  • You have the legal capacity to enter into a binding agreement; or

Parents and guardians are responsible for purchases made by minors using their devices, accounts or payment methods where legally applicable.

We make reasonable efforts to ensure that product descriptions, stationery pack contents, images, quantities, brands, specifications and prices are accurate.

  • Product packaging may differ from the images displayed;

  • Manufacturers may update packaging or product designs without notice;

  • Images may be used for illustration purposes;

  • Minor product variations may occur;

  • Product availability may change without notice; and

  • Typographical, pricing or product-description errors may occasionally occur.

The description displayed on the relevant product page at the time of purchase will form part of the order.

Customers must review the product title, pack description, grade, quantity, contents and specifications before placing an order.

5. Stationery Pack Contents

Each stationery pack will contain the items listed in the product description at the time the order is placed.

Unless specifically stated otherwise:

  • Decorative items shown in images are not included;

  • Quantities apply only as listed in the description;

  • Pack contents may differ between grades, schools, universities, offices or product options;

  • Individual product warranties may be provided by the relevant manufacturer; and

  • Products sold as part of a pack are intended to be purchased together.

We will not substitute an item with a different item without informing the customer, unless:

  • The substitute is substantially similar;

  • It serves the same purpose;

  • It is of equal or greater value;

  • The substitution is permitted by law; and

  • The customer is given any cancellation or return rights required by law.

Where a suitable substitute is unavailable, we may contact the customer to arrange an alternative, partial refund or cancellation.

6. School and Institution Lists

Stationery packs may be prepared using lists supplied by schools, universities, teachers, institutions, employers or customers.

We are not responsible for errors, omissions or outdated requirements contained in lists supplied by third parties.

Customers must confirm that the selected pack is suitable for the correct:

  • School or institution;

  • Grade or year;

  • Class;

  • Subject;

  • Course;

  • Department; and

  • Academic period.

Where a customer selects the wrong pack, our Return and Refund Policy will apply.

7. Orders

An order is an offer by the customer to purchase the selected products.

After an order is submitted, the customer may receive an automatic confirmation email. This email confirms that we received the order but does not necessarily mean that the order has been accepted.

An order is accepted once:

  • Payment has been successfully confirmed;

  • The order has been reviewed;

  • Stock has been confirmed; and

  • We begin preparing or dispatching the order.

We reserve the right to reject or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • A price or product description contains an obvious error;

  • Payment cannot be verified;

  • Fraud or unauthorised payment is suspected;

  • The customer has provided incorrect information;

  • The customer has breached these Terms;

  • We cannot deliver to the provided address; or

  • The order appears to be intended for unlawful resale or misuse.

Where we cancel a paid order, we will refund the applicable amount using the original payment method, subject to applicable law.

8. Order Changes and Cancellations

Customers must contact us as soon as possible if they want to change or cancel an order.

We cannot guarantee that an order can be changed or cancelled after:

  • Payment has been processed;

  • The pack has been assembled;

  • A personalised or customised pack has entered preparation;

  • A shipping label has been created; or

  • The order has been handed to the courier.

Where cancellation is still possible, reasonable costs already incurred may be deducted only where permitted by law.

Any statutory cancellation or cooling-off rights will continue to apply where legally applicable.

9. Prices

All prices are displayed in South African rand unless stated otherwise.

Prices may include or exclude VAT depending on our VAT-registration status and the information displayed at checkout.

The total price payable will be shown before the customer completes payment and may include:

  • Product costs;

  • VAT, where applicable;

  • Delivery fees;

  • Optional services; and

  • Any other clearly disclosed charges.

We may change prices at any time without prior notice. Price changes will not affect orders that have already been accepted, except where there was an obvious and genuine pricing error.

10. Pricing Errors

We make reasonable efforts to display accurate prices.

Where a product is listed at an obviously incorrect price because of a technical, system, supplier or human error, we may contact the customer before fulfilling the order.

The customer may choose to:

  • Continue with the order at the correct price; or

  • Cancel the affected item or order and receive a refund.

We will not be required to supply a product at an obvious error price where doing so would be unreasonable or unlawful.

11. Promotions and Discount Codes

Promotions, sales, competitions and discount codes may be subject to additional terms.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash;

  • Only one discount code may be used per order;

  • Discount codes cannot be applied after an order has been completed;

  • Discounts exclude delivery fees;

  • Promotions are valid while stocks last;

  • Promotions may only apply to selected products;

  • Expired discounts will not be accepted; and

  • Discounts may not be combined.

We may cancel a discount or promotional order where the promotion was used fraudulently, unlawfully or contrary to its stated conditions.

12. Payment

Payment must be made using one of the payment methods available at checkout.

By submitting payment information, you confirm that:

  • You are authorised to use the selected payment method;

  • The information provided is correct;

  • Sufficient funds or credit are available; and

  • The payment is not fraudulent or unlawful.

Payments may be processed by third-party payment providers. We do not control their processing times, security procedures, system availability or approval decisions.

An order will not be prepared or dispatched until payment has been successfully confirmed, unless we have agreed otherwise in writing.

13. Fraud Prevention

We may perform reasonable fraud-prevention and order-verification checks.

We may request:

  • Proof of identity;

  • Proof of payment;

  • Confirmation of billing information;

  • Confirmation from the payment account holder; or

  • Additional information required to verify the order.

We may place an order on hold or cancel it where the requested verification is not supplied within a reasonable period.

Fraudulent transactions may be reported to payment providers, banks or law-enforcement authorities.

14. Stock Availability

All products and stationery packs are subject to availability.

Adding an item to a cart does not reserve stock.

Where an item becomes unavailable after an order has been placed, we may:

  • Offer a suitable substitute;

  • Offer a product of equal or greater value;

  • Remove the unavailable item and issue a partial refund;

  • Delay the order with the customer’s agreement; or

  • Cancel and refund the affected portion of the order.

We will contact the customer before making a material substitution.

15. Personalised and Customised Orders

Personalised or specially prepared stationery packs may include:

  • Printed names;

  • Custom labels;

  • School-specific contents;

  • Customer-selected colours;

  • Special quantities;

  • Custom branding; or

  • Packs assembled according to an individual list.

Customers are responsible for checking all spelling, names, quantities, dimensions and customisation details before submitting an order.

Once production or assembly has begun, personalised or customised orders may not be cancelled or returned for a change of mind, except where required by law.

This does not affect the customer’s rights where the product is defective, incorrectly personalised because of our error or does not match the approved order.

16. Delivery

We currently deliver to addresses within [South Africa / delivery areas].

Estimated delivery generally takes approximately 3–5 business days, unless a different timeframe is displayed at checkout or communicated to the customer.

Business days exclude Saturdays, Sundays and South African public holidays.

Delivery timeframes are estimates and may be affected by:

  • Courier delays;

  • Peak shopping or back-to-school periods;

  • Public holidays;

  • Severe weather;

  • Load shedding or service disruptions;

  • Strikes;

  • Road closures;

  • Remote delivery locations;

  • Supplier delays;

  • Incorrect address information; or

  • Other events outside our reasonable control.

We will make reasonable efforts to communicate material delays.

17. Delivery Information

Customers must provide a complete and accurate:

  • Recipient name;

  • Street address;

  • Suburb;

  • City or town;

  • Postal code;

  • Email address; and

  • Contact number.

We are not responsible for delays or failed deliveries caused by incorrect, incomplete or outdated information supplied by the customer.

Additional delivery charges may apply where an order must be redirected or redelivered because:

  • The address was incorrect;

  • Nobody was available to receive the parcel;

  • The customer refused delivery without lawful reason; or

  • The parcel was not collected from a designated collection point.

Any additional charges will be communicated to the customer where reasonably possible.

18. Delivery and Transfer of Risk

Risk in the goods remains with us until the order is delivered to the customer or a person authorised by the customer to receive it, subject to applicable law.

Delivery may be confirmed through:

  • A courier scan;

  • A recipient signature;

  • A delivery photograph;

  • A collection confirmation;

  • A one-time PIN;

  • Electronic courier records; or

  • Other reasonable proof of delivery.

Customers must ensure that someone is available to receive the parcel.

Where a customer instructs the courier or us to leave a parcel unattended at a specific location, risk may pass to the customer when the parcel is left according to those instructions, to the extent permitted by law.

19. Failed Delivery

Where delivery fails, the courier may attempt redelivery or return the parcel to us.

If the parcel is returned because the customer:

  • Supplied an incorrect address;

  • Failed to respond to the courier;

  • Was unavailable after reasonable delivery attempts;

  • Failed to collect the parcel; or

  • Refused delivery without a lawful reason,

the customer may be required to pay a reasonable redelivery fee before the order is sent again.

Where the order is cancelled after being returned to us, reasonable delivery or return costs may be deducted from the refund where permitted by law.

20. Inspection of Orders

Customers should inspect their order as soon as reasonably possible after delivery.

Customers should contact us within 7 calendar days after delivery where:

  • The wrong stationery pack was delivered;

  • An incorrect item was supplied;

  • An item is visibly damaged;

  • The parcel appears to have been tampered with; or

  • An item is missing.

The customer may be required to provide photographs or videos of:

  • The outer packaging;

  • The courier label;

  • The stationery pack;

  • All items received; and

  • Any damage or tampering.

Reporting an issue within seven days helps us investigate courier and packing records promptly. This period does not limit any longer statutory rights that may apply to defective or unsafe goods.

21. Returns and Refunds

All returns, refunds, replacements and exchanges are governed by our Return and Refund Policy.

In particular:

  • Used stationery cannot be returned for a change of mind;

  • Items that have been written on, sharpened, opened, altered or damaged after delivery may not qualify for return;

  • Incorrect packs or incorrect items should be reported within seven calendar days;

  • All returned pack contents must be included;

  • Missing returned items may be deducted from the refund where legally permitted;

  • Defective goods remain subject to the rights provided by applicable South African law; and

  • Personalised goods may be excluded from change-of-mind returns where permitted by law.

Our Return and Refund Policy forms part of these Terms of Service.

22. Warranties and Product Quality

We aim to supply goods that are:

  • Of good quality;

  • In good working order;

  • Reasonably suitable for their intended purpose;

  • Free from material defects; and

  • Consistent with their product descriptions.

Manufacturer warranties may apply to certain branded products.

A warranty may not apply where damage was caused by:

  • Misuse;

  • Negligence;

  • Accidental damage;

  • Incorrect storage;

  • Normal wear and tear;

  • Failure to follow instructions;

  • Unauthorised alterations; or

  • Use for a purpose for which the product was not intended.

Nothing in this section limits the customer’s rights under the Consumer Protection Act.

23. Customer Accounts

Customers may be permitted to create an account on our website.

You are responsible for:

  • Keeping your login details confidential;

  • Providing accurate account information;

  • Updating your information when it changes;

  • Restricting access to your account and devices; and

  • All activity that takes place through your account.

You must notify us promptly if you believe your account has been accessed without permission.

We may suspend or terminate an account where there is suspected fraud, misuse, abuse or a material breach of these Terms.

24. Acceptable Use

You may not use our website to:

  • Commit fraud or any unlawful act;

  • Upload viruses or malicious code;

  • Attempt to gain unauthorised access to our systems;

belongs to us or is used with permission from the relevant owner.

You may not copy, reproduce, modify, distribute, sell, publish or commercially exploit our content without prior written permission.

Product names, logos and trademarks belonging to third-party stationery manufacturers remain the property of their respective owners.

The sale of a branded product does not imply that the brand owner sponsors, operates or endorses our store unless expressly stated.

26. Reviews and Customer Content

Where customers submit reviews, photographs, comments or other content, they confirm that:

  • The content is truthful;

  • They have the right to submit it;

  • It does not infringe another person’s rights;

  • It is not unlawful, defamatory, threatening or discriminatory; and

  • It does not contain malicious code or misleading information.

By submitting content to us, you grant us a non-exclusive, royalty-free permission to use, reproduce and display it for business and marketing purposes, unless prohibited by law or withdrawn where legally applicable.

We may remove content that violates these Terms, but we will not remove genuine negative reviews merely because they are unfavourable.

  • A pack will satisfy every requirement of a school, teacher, university or employer unless expressly confirmed;

  • Product images will display identically on every screen;

  • Every product will remain continuously available; or

  • The website will be free from every technical error.

Nothing in this section excludes any warranty or obligation imposed by applicable law.

33. Limitation of Liability

To the maximum extent permitted by South African law, we will not be liable for indirect, incidental or consequential loss arising from the use of our website or products where such loss was not reasonably foreseeable.

We will not be responsible for loss caused by:

  • Customer misuse or negligence;

  • Incorrect information provided by the customer;

  • Unauthorised use of a customer’s account or payment method where we were not at fault;

  • Delays outside our reasonable control;

  • Third-party systems outside our control; or

  • Use of products contrary to their instructions or intended purpose.

Where we are legally liable, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for:

  • Gross negligence;

  • Fraud;

  • Wilful misconduct;

  • Death or personal injury caused by unlawful conduct;

  • Defective or unsafe goods where liability cannot legally be excluded; or

34. Indemnity

A consumer will not be deprived of any right to approach a court or body with lawful jurisdiction.

38. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent legally possible or removed where necessary.

The remaining provisions will continue to apply.

39. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

Any waiver must be given in writing.
